In its efforts to enhance investor protection around the continent, ESMA, the regulator for investment services in the EU, has continued to update a Q&A on related topics. In this recent update the authority makes clarifications on the sale of subordinated eligible liabilities, on the information to be collected from clients and the process to be followed when a transaction on specific liabilities is deemed unsuitable by the firm, but the retail client wishes to proceed anyway. These efforts are intended to support investment firms in correctly applying the requirements of a number of regulations and directives that increase transparency across the European Union’s financial markets and standardizes the regulatory disclosures required for particular markets.
